Terms & Conditions

1.    General

1.1 All contracts between Visible Media UK Ltd and any client will be subject to the following terms and conditions unless otherwise agreed in writing.

2.    Copyright & Ownership
2.1 The copyright of all images and footage remains with Visible Media UK Ltd unless otherwise agreed in writing.
2.2 The ownership of all images and footage remains with Visible Media UK Ltd unless otherwise agreed in writing.
2.3 The images or footage supplied by Visible Media UK Ltd to the client are not for resale by the client.
2.4 The images or footage supplied by Visible Media UK Ltd to the client are not for use by a third party without prior arrangement with Visible Media UK Ltd.
2.5 Reproduction rights of the images and footage supplied to the client by Visible Media UK Ltd will be granted to the client for all future publicity and PR purposes. Visible Media UK Ltd guarantees not to make any further charges for the use of the supplied images providing their use does not contravene any of the above conditions.

3.    Reproduction & Usage
3.1 Visible Media UK Ltd will not be responsible for the quality of any image supplied to the client and subsequently reproduced by a third party.
3.2 Visible Media UK Ltd reserves the right to use any image or section of footage for its own marketing purposes, in newsletters, portfolios competitions or exhibitions.
3.3 Stock images provided by Visible Media UK Ltd to the client are sold on a non-exclusive use basis unless otherwise agreed in writing.

4.    Assignments & Cancellations
4.1 Once a filming/photography date is arranged, any alteration of the date or timings should be notified to Visible Media UK Ltd immediately.
4.2 Once a filming/photography date is arranged any subsequent cancellation by the client will be subject to the following charges:
Cancellation within one week of the filming/photography date -
25% of the total project price
Cancellation within 48 hours of the filming/photography date -
50% of the total project price
Cancellation within 24 hours of the filming/photography date -
100% of the total project price plus any additional expenses incurred
4.3 In order to honour a particular filming/photography date Visible Media UK Ltd reserves the right to substitute another photographer/director as required.
4.4 Images/footage will be presented to the client within the timescale agreed between the client and Visible Media UK Ltd. Visible Media UK Ltd reserves the right to charge extra for urgent delivery or “out of hours” working when necessary.

5.    Disputes or Dissatisfaction
5.1 In the unlikely event of a client being dissatisfied with the results of images/footage or any other product supplied by Visible Media UK Ltd, complaints must be made verbally as soon as possible and in writing within 48 hours. Visible Media UK Ltd will make every effort to rectify the situation.

6.    Invoices and Payment Terms
6.1 Payment of all invoices raised by Visible Media UK Ltd must be made within 30 days of the date of the invoice.
6.2 Late payment of any invoice will result in the invoice incurring a “late payment administration charge” of £50.00 which will be added to the invoice total. Interest will be added to the overdue invoice (including the £50 administration charge) at 5% per month until full payment is received.
6.3 If payment of an overdue invoice is not received by Visible Media UK Ltd and the client has not complied with clause 5.1 of the standard terms and conditions (above), then Visible Media UK Ltd reserves the right to take legal action to recover the full amount, including administration charge and interest, plus costs.
